Limitation of Liability

This section limits our legal responsibility for damages that may arise from using Zirzoner. Please read it carefully.

Our Liability Is Limited

To the fullest extent permitted by law, Zirzoner and its team members, affiliates, and service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages.

This includes damages for:

• Loss of profits or revenue
• Loss of data or content
• Loss of business or opportunity
• Loss of goodwill or reputation
• Cost of substitute services
• Any other indirect or unexpected losses

What This Means

If something goes wrong while using Zirzoner, our financial responsibility to you is limited. We are not responsible for:

• Business losses you experience
• Data you lose because of platform issues
• Opportunities you miss due to downtime
• Decisions you make based on platform information
• Problems caused by third-party services

Cap on Liability

If we are found liable for any reason, our total liability to you will not exceed:

• The amount you paid to Zirzoner in the 12 months before the claim
• Or 100 US dollars if you have not made any payments

This cap applies regardless of the legal theory on which the claim is based, including contract, tort, negligence, or strict liability.

Exceptions

Some jurisdictions do not allow the limitation of certain types of liability. In those jurisdictions, our liability is limited to the maximum extent permitted by law.

Nothing in these terms limits or excludes liability for:

• Death or personal injury caused by negligence
• Fraud or fraudulent misrepresentation
• Any other liability that cannot be excluded by law

No Liability for User Actions

We are not responsible for:

• Actions or content of other users
• Disputes between users
• Losses caused by other users' behavior
• Content posted by third parties

No Liability for Third-Party Services

We are not responsible for:

• Third-party services integrated with Zirzoner
• Payment processing errors by third-party providers
• Hosting or infrastructure failures by our providers
• Content or services on linked third-party websites

Time Limit for Claims

Any claim related to your use of Zirzoner must be filed within the time period required by applicable law. After that period, claims are permanently barred.

Basis of the Agreement

You acknowledge that:

• These limitations of liability are a fundamental part of these terms
• Zirzoner would not provide services without these limitations
• The limitations apply even if the remedies provided fail their essential purpose
